1. Information on how to enter and the prizes forms part of these Conditions of Entry.
2. The Promoter is The Westin Sydney, No. 1 Martin Place, Sydney NSW 2000, operated by Starwood Pacific Hotels P/L (ABN 48 000 575 048) solely as representative for Ausco Martin P/L (ABN 65 100 242 368).
3. Entry is only open to persons aged 18 years and over ("Eligible Entrants"). The officers, management and employees (and their immediate families) of the Promoter and its related bodies corporate and any agencies associated with this promotion are ineligible.
4. Exclusive benefits are offered to bookers when a group and/or event contract before January 31, 2009 and materialise between October 1 2008 and September 30 2009. Bookers must spend over AU$25,000 (inclusive of GST) to receive their choice of one benefit from the following or spend AU$50,000 (inclusive of GST) to receive their two choices from the following or spend AU$75,000 (inclusive of GST) to receive their three choices from the following inclusions
o 1 Executive Suite upgrade (must be taken during the event, subject to availability)
o 2 Executive Club upgrades (must be taken during the event, subject to availability)

Should bookers be entitled to pick more than one inclusion, each inclusion may only be selected once. The minimum total spend of AU$25,000.00 (inclusive of GST) must be from one event only and not cumulative events.
5. To redeem one night at The Westin Sydney for an Escape Package including overnight accommodation in a tower superior king room, breakfast for two in Mosaic Restaurant, a local newspaper and a late check out of 1 pm upon availability, Eligible Entrants must contract before January 31 2009 and materialize a conference, event or meeting business with a minimum spend of AU$25,000.00 (AU$ including GST) at The Westin Sydney between October 1 2008 and September 30 2009.
6. Eligible entrants automatically go into the draw to win 5 nights accommodation at one of 10 Westin properties in Whistler, San Francisco, New York, Maui, Fiji, Bali, Shanghai, Paris, Dubai or Turnberry with return economy airfares for two from either Sydney, Melbourne or Brisbane.
7. The minimum spend of AU$25,000.00 (AU$ including GST) can be from one conference, event or meeting only during the specified time period or validity of the promotion.
8. The minimum spend of AU$25,000.00 (AU$ including GST) can be a residential or non residential event.
9. Only expenditure at The Westin Sydney during the specified time of October 1 2008 until September 30, 2009 on accommodation room revenue for a group and/or food and beverage and / or function room hire associated with a conference, event or meeting will be eligible for determining the minimum spend. Revenue received from audio visual and by third parties is not eligible.
10. This promotion strictly applies to new business only, contracted (with deposit) after October 1 2008 and before January 31 2009. Eligible Entrants must book and contract an estimated minimum spend of AU$25,000 (AU$ including GST) at The Westin Sydney between October 1 2008 and January 31 2009 to materialize before September 30, 2009
11. Only one entry per materialised conference, event or meeting is permitted. In the case of a multiple claim being made on the one conference, event or meeting by two or more involved parties, The Westin Sydney will assign eligibility for entry into the prize draw at its discretion.
12. Should an entrant book more than one non consecutive event or meeting, the entrant is eligible to register again for the promotion as a separate entry.

14. No responsibility accepted for late, lost or misdirected entries. It is the responsibility of the Eligible Entrant to notify The Westin Sydney of any change of contact detail during the promotional period.
15. Promotion commences 00:01 AEDST on October 1 2008. Entries close 11:59pm AEDST on January 31 2009. The draw will take place at The Westin Sydney, 1 Martin Place NSW 2001 on October 9, 2009, 12:00 AEDST. Winners will be notified by telephone.
16. The first valid entry drawn for a booking during the promotional period will win:

17. Spending money, taxes, insurance, transfers, excess baggage charges, and all other ancillary costs are the responsibility of the winner.
18. Prize must be redeemed by December 20, 2009 and is subject to booking and flight availability. All airfares, transfers and accommodation are subject to availability at the time of booking. No extensions will be permitted. Advance reservations are required. Blackout dates may apply.
19. Total maximum prize value is up to AU$10,000.00 (AU$ including GST). The Westin Sydney accepts no responsibility for any variation in the prize value.
20. Prizes are not to be used in conjunction with any other promotion.
21. Prize or any unused portion of prize is not transferable or exchangeable and cannot be taken as cash. The prize elements of the Escape package and/or the Grand Draw prize must all be redeemed in conjunction with one another, as a package. Any cancellation fees and other costs will be at the prize winner’s expense.
22. The Westin Sydney may conduct such further draws at the same place as the original draw as are necessary on October 30 2009 at 2pm AEDST in order to distribute the prizes if unclaimed by that time and date.
23. If for any reason this competition is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of The Westin Sydney which corrupts or affect the administration security, fairness, integrity or proper conduct of this competition, The Westin Sydney reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by the various Lottery Departments, to cancel, terminate, modify or suspend the competition.
24. The Westin Sydney is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the internet or any web site, or any combination thereof, (including but not limited to) any injury or damage to participants or any other person's computer related to or resulting from participation in or down-loading any materials in this competition. Any costs associated with accessing the promotional website is the entrant's responsibility and is dependent on the internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid.
25. In the case of intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest or strikes, The Westin Sydney may cancel the promotion and recommence it from the start on the same conditions subject to any written direction from the various lottery departments.
26. Eligible Entrants enter and participate in the promotion at their own risk. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of taking the prize, except for any liability which cannot be excluded by law.
27. It is a condition of accepting the prizes that the winner (and companion) may be required to sign a legal release in a form determined by The Westin Sydney in its absolute discretion.
28. The Westin Sydney reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if The Westin Sydney determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prizes
29. In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right to cancel, terminate, modify or suspend the promotion subject to any written directions from the various lottery departments.
30. The Westin Sydney collects entrants' personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each entrant also agrees that The Westin Sydney may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. Entrants' personal information may be disclosed to State and Territory lottery departments and winners' names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to The Westin Sydney at their address set out above.
31. The Westin Sydney reserves the right to request winners to provide proof of age, identity and residency prior to awarding the prizes. Identification considered suitable for verification is at the discretion of The Westin Sydney. In the event that the winner cannot provide suitable proof, the winner will forfeit their prize in whole and no substitute will be offered.
32. The Westin Sydney reserves the right to conduct security verification checks at their absolute discretion. Prize winners may be required to sign a declaration confirming their eligibility to accept the prize.
33. The prize winners are advised that tax implications may arise from their prize winnings and s/he should seek independent financial advice prior to acceptance of the prize.
